Probate

 

Probate involves a court proceeding to appoint a Personal Representative and determine distribution of property of a deceased person. This can be done either testate (if the deceased died with a Will) or intestate (if the deceased died without a Will).

 

Information Needed:

  • Name, address, and date of death of Deceased.
  • Names and addresses of spouse, children, and if none, parents of the Deceased.
  • A list of assets of the Deceased including a description of the particular asset, location of asset, date of death value of asset, whether or not there was a joint owner or a beneficiary named as to each asset.

 

Documents to bring to first appointment:

  • Will and/or Trust;
  • Death Certificate.
